Furnished Rental Agreement and Terms and Conditions for Casas de Santa Fe, Inc. 

This is an Agreement between you, the TENANT, and the Owner of the PROPERTY. Casas de Santa Fe, Inc. acts as the Owner’s agent with power of attorney. By completing your reservation, you confirm that Casas de Santa Fe, Inc. is reserving the PROPERTY for you during the TERM OF OCCUPANCY, subject to the terms and conditions outlined below. 

CHECK IN/CHECK OUT

Check-in time is after 3:00 pm and check-out is 10:00 am. An early check-in or late check-out can be coordinated if available for a fee of $50.00. $50.00 will be charged for any keys and/or security gate swipe cards that are not returned upon check-out. 

OCCUPANCY

By city ordinance, occupancy may not exceed what is posted for each home. Maximum occupancy includes infants and children. 

SMOKING

All properties are non-smoking. 

PETS

Pets are allowed at pet-friendly properties only. Pets that occupy a property must be approved by the property’s owner. 

TERMS OF PAYMENT

A 50% deposit is required at the time the reservation is confirmed and will be applied to the total amount due. The final payment is due 60 days before your arrival. All monies paid are non-refundable at that point. The final payment will be billed to your credit card unless other payment arrangements have been made. 

We accept VISA, MASTERCARD, AMERICAN EXPRESS, personal and certified checks, as well as money orders. 

CANCELLATION POLICY

If you cancel your occupancy more than 30 days before the lease term begins, your rent deposit will be refunded, less a handling fee in the amount of 10% of the gross lease amount. If you cancel within 30 days of your arrival date, you will receive no refund unless Casas de Santa Fe is able to re-book the house for the same time period at the same rate. In that instance, you will be refunded 75%. 

DAMAGE AND PET DEPOSIT

A Credit Card on file or Security Deposit Insurance must be agreed upon, prior to arrival, as a security deposit to cover all damages incurred such as breakage or damage to the appliances, furnishings, or the property itself. The open credit card voucher is also for the purpose of covering any damage as a result of the occupancy of a pet. 

CLEANING

All guests are expected to maintain the property in reasonable condition during their stay. If the property is left in such a condition that requires more cleaning than usual, an additional fee will be charged to your credit card. Should your occupancy be 30 days or longer, you will be required to have the house cleaned at least once every two weeks at your expense and cleaned by a Casas de Santa Fe housekeeper. 

TRAVEL INSURANCE

Guests may have the option to purchase travel insurance from Rental Guardian Insurance. The travel insurance is charged at a cost of 7% of the total reservation charges. Questions regarding travel insurance, please contact Rental Guardian Travel Insurance at 1- 833-610-0736

  1. Completing Your Reservation 

Carefully review these Terms and Conditions. 

Review this document where indicated. 

Submission of your booking confirms your acceptance of these Terms and Conditions. 

The RENT DEPOSIT is due within one week of your booking to secure your reservation; otherwise, your reservation will be canceled. 

  1. Fixed Term and Rent 

TENANT agrees to pay the TOTAL DUE (inclusive of RENT and FEES) in advance to Casas de Santa Fe, Inc., located at 1323 Paseo de Peralta, Suite A, Santa Fe, NM 87501. Payment confirms acceptance of this FURNISHED RENTAL AGREEMENT. 

  1. Payment of Rent 

TENANT shall pay the RENT DEPOSIT at the time of signing this Agreement. 

The BALANCE DUE must be paid by the date specified on the reservation invoice. Failure to pay by the due date will result in cancellation of the reservation. 

  1. End of Tenancy 

TENANT must vacate the PROPERTY by the specified date and time. 

All windows and doors must be locked, keys returned, and the PROPERTY left in a clean condition. 

Fees for unreturned keys: $50 per key. Fees for unreturned garage/gate remotes: $150 per remote. 5. Occupancy Limit 

TENANT agrees not to exceed the MAXIMUM NUMBER OF OCCUPANTS permitted for the PROPERTY. 6. House Supplies 

The PROPERTY is stocked with initial supplies (toilet paper, paper towels, trash bags, etc.). Additional supplies are the responsibility of the TENANT. 

  1. Cancellation Policy 

Cancellation more than 30 days before occupancy: Rent Deposit will be refunded minus a 10% handling fee. 

Cancellation 30 days or fewer before occupancy: Refunds are contingent on rebooking the PROPERTY. If rebooked, a 25% administrative fee will apply. 

  1. Property Condition 

TENANT accepts the PROPERTY in habitable condition and must report damages immediately. 

Unauthorized repairs are prohibited. 

  1. Security Deposit and Accidental Damage Fee 

A non-refundable Accidental Damage Fee covers accidental damages up to $1,000 and does cover damages caused by pets. 

TENANT is responsible for unreported damages, intentional damages, and damages exceeding $1,000. 

  1. Cleaning Requirements 

A CLEANING FEE is included in the TOTAL DUE. 

Properties rented for more than 4 weeks require biweekly cleaning, arranged by Casas de Santa Fe, Inc. Additional cleaning fees apply. 

  1. Pet Policy 

Pets are permitted only with prior approval for properties that allow pets. 

A $350 non-refundable Pet Fee applies for one pet & $500 for two Pets. 

TENANT is liable for any damages or additional cleaning related to pets. 

Pet waste must be promptly removed from all areas of the PROPERTY. 

Pets are not allowed on furniture or in hot tubs. Any evidence of pets in restricted areas will incur additional fees. 

Lessee is responsible and liable for: 

  1. any damage to the Property or any item in the Property caused by any pet; b. any personal injuries to any person caused by any pet; and 
  2. any damage to any person’s property caused by any pet.

Tenant will pay all reasonable costs that are necessary to clean, deodorize, deflea, or repair any part of the Property, including but not limited to the carpets, doors, walls, drapes, wallpaper, windows, screens, furniture, appliances, sod, yard, fences, or landscaping. 

If any evidence of pet is on property (waste, urine) both smell and/or visual, it must be removed before property is vacated. This includes scratches and stains on flooring and carpet. Any damages and/or additional cleaning required over and above the $350 pet fee will be charged to the Tenant’s credit card on file. 

Tenant must remove or confine any pet at any time that the pet is likely to limit or prohibit Agent or other person’s access to Property as permitted by the Lease. 

INDEMNIFICATION: Lessee will protect, defend, indemnify, and hold Owner and Agent’s, and Agent’s agents harmless from any damages, costs, attorney’s fees, and expenses that are caused by the act of any pet or Lessee. 

  1. Pool, Hot Tub, and Water Feature Waiver 

TENANT acknowledges that use of pools, hot tubs, and water features involves risks of injury. TENANT assumes responsibility for the safety of all occupants and guests using these features. 

TENANT agrees to indemnify Casas de Santa Fe, Inc. and the Owner against claims arising from use of these features. 

Proper precautions must be taken to secure the area and prevent unauthorized use. 13. Key and Remote Control Return 

Lost or unreturned keys: $50 fee. 

Lost or unreturned remotes: $150 fee. 

  1. Conduct on Property 

NO SMOKING is allowed on the PROPERTY. 

Compliance with local laws and community rules is required. 

TENANT is responsible for damages resulting from moving furniture or intentional misuse of the PROPERTY. 

  1. Guest Conduct 

TENANT is responsible for ensuring guests adhere to the rules outlined in this Agreement. 16. No Assignment 

The Agreement is non-transferable and subletting is prohibited. 

  1. Right of Entry 

Casas de Santa Fe, Inc. may enter the PROPERTY for inspections, repairs, or showings with reasonable notice. 

  1. Environmental Conditions and Assumption of Risk 

TENANT assumes all risks associated with environmental conditions on the 

PROPERTY and releases Casas de Santa Fe, Inc. from liability. 

  1. Risk of Loss 

TENANT is responsible for insuring personal property during the stay. Casas de Santa Fe, Inc. and the Owner bear no liability for loss or damage. 

  1. Lost and Found 

Recovery of lost items will incur a $50 fee, plus shipping expenses. 

  1. Indemnification and Hold Harmless 

Neither Casas de Santa Fe, Inc. nor Owner shall be liable for any injury or damage to persons or property arising from act or omission of TENANT, TENANT’S family, TENANT’S guests, TENANT’S invitees or visitors. Neither Casas de Santa Fe, Inc. nor Owner will be liable for losses or damages to TENANT’S property by theft, vandalism, fire, smoke, water, rain, hail, ice, snow, explosion, acts of God, acts of other residents, or any other causes other than as a direct and proximate result of the gross negligence of Agent or Owner. TENANT will hold harmless Casas de Santa Fe, Inc. and Owner, and their employees and agents, from any liability due to loss or damage to the property of TENANT or others present on the PROPERTY from any cause other than gross negligence or the intentional acts of Casas de Santa Fe, Inc., Owner or their employees and agents.

  1. Substitute Property 

If the reserved PROPERTY becomes unavailable, Casas de Santa Fe, Inc. will provide a substitute property or refund all payments. 

  1. Air Conditioning 

Not all properties are equipped with air conditioning. Verify amenities with your leasing agent. 25. Mechanical Malfunctions 

Report malfunctions promptly. Casas de Santa Fe, Inc. is not liable for mechanical failures or reimbursement for inconveniences. 

  1. Disputes 

This Agreement is governed by the laws of New Mexico. Any legal disputes will be resolved in Santa Fe County, NM. 

  1. Tenant Warranty 

By electronically booking, TENANT confirms they have read and understood this Agreement and are authorized to sign on behalf of all occupants.
